LEGAL DISCLAIMER, WAIVER, AND RELEASE

PLEASE READ THIS LEGAL DISCLAIMER, WAIVER, AND RELEASE CAREFULLY BEFORE YOU USE THIS APPLICATION, MASTER YOUR HEALTH AND THE WEBSITE LOCATED AT MASTER-YOUR-HEALTH.COM  (COLLECTIVELY THE “APP”). BY USING THIS APP, THE CLIENT IS WAIVING ANY CLAIMS AGAINST MASTER YOUR HEALTH, LLC AND ITS MANAGERS, MEMBERS, AGENTS, EMPLOYEES, AND AFFILIATES INCLUDING AMANDA MEIXNER ROCCHIO AND CHRISTOPHER ROCCHIO (COLLECTIVELY “MASTER YOUR HEALTH”), AS SET FORTH BELOW.

The App’s content is not a substitute for direct, personal, professional medical care, and/or diagnosis. None of the meal plans or exercise programs should be performed or otherwise used without clearance from your physician or health care provider first. You agree to consult,  and obtain approval from, your medical professional before beginning ANY meal plan or exercise program, no exceptions. The information contained within is not intended to provide specific physical or mental health advice, or any other advice whatsoever, for any individual or company and should not be relied upon in that regard. 

Master Your Health and its coached are not medical professionals and nothing on this website should be taken as medical advice. Content provided on the App and any affiliated media, including meal plans, exercise programs or via email coaching, is not meant as a substitute for medical advice. You are using the App’s plans, programs, workouts and coaching at your own risk.  Master Your Health is not responsible for any injuries or health issues, up to and including death, that you may experience as a result of using any of the App’s products or services.

RISKS OF PRODUCT USE

There may be risks associated with participating in activities provided or mentioned on the App. Because these risks exist, you will not participate in any meal plans available to you on the App if you are in poor health or have a pre-existing mental or physical condition. As with any exercise program you assume certain risks to your health and safety. Any form of exercise program can cause injuries, and the App is not an exception. It is possible that you may become injured doing the exercises in your program, especially if exercises are performed using the incorrect and/or poor form. 

If you choose to use the App and the meal planning content and/or exercise program therein, you do so of your own free will and accord, and you knowingly and voluntarily assume all risks associated with such dietary and exercise activities. 

RELEASE

YOU HEREBY REMISE, RELEASE, AND FOREVER DISCHARGE MASTER YOUR HEALTH and all of its current and former agents, officers, directors, shareholders, volunteers, managers, servants, successors, assigns, employees, consultants, subsidiaries, and affiliates from any present or future causes of action, claims or demands of any kind, including (without limitation) claims for loss, damage, injury, costs, legal fees and related disbursements (individually and collectively the “Claim”) including, but not limited to:

1. Any claim related to negligence.  Negligence includes failure to use such care as a reasonably prudent and careful person would use under similar circumstances and failure to meet any safety standards of care.
2. Any claim related to the failure to take reasonable steps to safeguard or protect yourself from the risks, hazards, and dangers related to the activities. 
3. Any claim related to your participation in activities provided on the App. 
4. General Release. 
   You expressly waive and relinquish all rights and benefits afforded by California Civil Code Section 1542 and understands and acknowledges the significance of this specific waiver of Section 1542, which states as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

GENERALLY EXPECTED RESULTS AND TESTIMONIAL DISCLAIMER

The App’s products and services are intended to be fully-implemented in order for you to see beneficial results.  However, Master Your Health and Meixner cannot guarantee you will achieve the results desired. 

All transformations and testimonials posted on the App are real.  These testimonials are not claimed to represent typical results with my meal plans and workout programs and do not serve as a guarantee that you will achieve similar results.  The testimonials serve as a showcase of what the most motivated and dedicated people can achieve by following my personalized meal plans and workout programs. Your results may vary, and you may not get the same results when compared to someone else due to differences in your individual exercise history, genetics, and personal motivation/dedication. 

IMPORTANT RECURRING SUBSCRIPTION BILLING INFORMATION

When you purchase a program through the website, you will be automatically charged monthly, and you will continue to receive new updated meal plans and workout programs for the time that you choose to remain a client.  In order to cancel your subscription simply send an email to support@master-your-health.com. 

GOVERNING LAW

This Waiver will be construed in accordance with, and be governed by, the laws of the State of California. The Client hereby agrees to the exclusive jurisdiction of the courts located in Los Angeles County, California with respect to any matter arising under or related to this Legal Disclaimer, Waiver, and Release.

CERTIFICATION 

You certify that the use of the App is your own free and voluntary act, and you intend this Legal Disclaimer, Waiver, and Release to be legally binding on you.  You further certify that you are 18 years old or older.
